・開催趣旨
 UNHCR事務所によると、世界には現在1000万人以上の無国籍者がいるといわれます。バルト三国の一角をなすラトヴィア共和国においては、その歴史的経緯により、人口の実に10%以上が無国籍者やノン・シティズン(non-citizens)で占められています。そこで、ラトヴィア共和国における無国籍者やノン・シティズンの実態と関連の法的枠組みについて学び、日本の状況と対比させながら今後の課題について考えることを目的に、本シンポジウムを企画いたしました。 
シンポジウムではまず、ラトヴィア共和国の法学者より、無国籍者やノン・シティズンに関する概要と法制度について報告があります。次に、ラトヴィア最高裁判所判事より、司法の実践やその役割について報告があります。これを受け、ラトヴィア共和国との比較を念頭におきつつ、日本の法実務家が日本の状況について報告します。以上を踏まえ、フロアを交えた対話や討議を進める予定です。 
本シンポジウムが、無国籍者やノン・シティズンへの対応のあり方を問い直す新たな機会となること願っています。

マールティンシュ・ミッツ(Mārtiņš Mits) 
法学博士(ルンド大学)。ラトヴィア大学人権研究所副所長、Latvian Human Rights Quarterly主任編集者を経て、2008年よりリガ法科大学院副学長。欧州人権条約やラトヴィア憲法についての著作多数。 
  
ダツェ・ミタ(Dace Mita) 
修士(人権・民主化:パドヴァ大学)。ラトヴィア環境保護・地域発展省法務部アドヴァイザー、ラトヴィア国会法務委員会アドヴァイザーなどを歴任。2006年よりラトヴィア最高裁判所行政事件部門判事に着任し、人権問題を専門とする。 
  
小田川綾音(おだがわ あやね) 
弁護士(2009年登録)。日本弁護士連合会人権擁護委員会難民認定問題特別部会特別委嘱委員、無国籍研究会主任研究員などを務め、難民、無国籍問題に取り組んでいる。 

 

勇基(いん ゆうき・ウン ヨンギ)

弁護士(1996年登録)。日本弁護士連合会人権擁護委員会日韓弁護士会戦後処理問題共同行動特別部会特別委嘱委員。在日コリアン弁護士協会会員。日本の国籍法を研究している。


小森宏美(こもり ひろみ) 
早稲田大学教育・総合科学学術院教授。専門はエストニア現代史。歴史認識と国家制度構築の関係に関心を有している。 
  
新垣修(あらかき おさむ) 
法学博士(ヴィクトリア大学)。専門は国際法と国際関係論。広島市立大学教授などを歴任し、2013年より国際基督教大学教授。

Aim and Outline

According to the Office of the UNHCR, there are at least one million stateless persons worldwide. In the Republic of Latvia, one of the Baltic states, ten percent of its population is stateless persons or non-citizens. This symposium aims to consider the historical background and legal framework concerning stateless persons and non-citizens in Latvia, comparing with the Japanese situation.

 

As the first report, a legal scholar from Latvia will present on legal framework of stateless persons and non-citizens. The second reporter is a judge of the Supreme Court in Latvia who will discuss judiciary practices. Then, the third reporter, a legal practitioner from Japan, talks about the Japanese situation of stateless persons and non-citizens in response to the reports of Latvia. Finally, a discussion and dialogue will follow, including audience members. The organisers hope that this symposium will be an opportunity for participants to re-consider the issues of stateless persons and non-citizens from the comparative perspectives of the two states.

Profiles

 

Dr. Mārtiņš Mits received his LL.D from the Lund University in Sweden. He has been the Deputy Director of the Human Rights Institute at the University of Latvia, Faculty of Law and a chief editor of the Latvian Human Rights Quarterly. He is currently a Prorector at the Riga Graduate School of Law. He has published various books and articles including the European Convention of Human Rights and the Latvian Constitution.

 

Ms. Dace Mita received the European Master in Human Rights and Democratization from University of Padova in Italy. She has been an advisor of the Legal Department in the Ministry of Environmental Protection and Regional Development, Republic of Latvia and Legal Committee, Saeima (Parliament of Latvia). Since 2006, she has been a Judge of the Department of Administrative Cases, the Supreme Court of Latvia.

 

Ms. Ayane Odagawa is an attorney-at-law. She is a member of the Special Section of Refugee Status Determination, Human Rights Protection Committee, the Japan Federation of Bar Associations (JFBA). She is also the chief researcher of the Study Group on Statelessness in Japan (Mukokuseki kenkyūkai). She is currently working on issues of refugees and stateless persons.


Mr. IN Yuki /EUN Yong-Ki is an attorney-at-law. He is a member of the Special Section for the Collective Action of National Bar Associations of Japan and Korea for  the Post-war Redress, Human Rights Protection Committee, the Japan Federation of Bar Associations (JFBA), and a member of Lawyers Association of ZAINICHI Koreans (LAZAK). He is currently studying the Japanese Nationality Act.  

 

Prof. Hiromi Komori serves for Faculty of Education and Integrated Arts and Sciences, Waseda University. She is a scholar of the contemporary history of Estonia.

 

Dr. Osamu Arakaki received his Ph.D. from Victoria University of Wellington. He is currently a professor at ICU. He is an expert of international law and international relations.




国際シンポジウム「無国籍者とノン・シティズン:ラトヴィアとの対話」には約80名の参加がありし、ラトヴィアにおける無国籍やノン・シティズンの実態を学んだうえで、日本の視座からも検討がなされました。
フロアからも積極的な参加があり、シンポジウムは盛況のうちに終わりました。
